Wills - Probate Applications - Letters of Administration Applications - Testamentary Trusts - Succession Act Claims

A Will is one of the most under rated administrative documents you will complete in your life. Regardless of age or health, everyone should have a Will to spare your loved ones from disputes and disagreements that can tear families apart. A Will saves others having to interpret your wishes, or being lumbered with an administrative burden after you die. When the time comes, we can assist your family in stepping through the necessities of obtaining Probate or Letters of Administration, paying your debts, and distributing your estate in accordance with your wishes. In many cases that includes properly excluding someone you do not want to leave a gift to. We offer a full range of services from basic wills, to more advanced structures creating testamentary trusts, or life interests in property. We offer an online Will drafting template, that will step you through the aspects you need to consider when preparing a Will. You can enter this data when it suits you, and in most cases we can prepare a draft Will for you the same day!

If you have been left out of a Will and you believe you should have been considered for a gift, we can discuss your options to negotiate with the Executor, and resolve the situation. If that doesn’t work, you may need to litigate in order to recover what the law says you are entitled to. Whilst the deceased can elect how their assets are to be dispersed, ultimately the law determines who is entitled to a distribution from a Will. In most states (unless an application is vexatious), the costs of the application, including our legal costs, are borne from the deceased estate, and there is no out of pocket cost to you. Strict time limits do apply to this area of law, so don't wait.
