If that doesn’t work, you may need to litigate in order to recover what the law says you are entitled to. Whilst the deceased can elect how their assets are to be dispersed, ultimately the law determines who is entitled to a distribution from a Will. In most states (unless an application is vexatious), the costs of the application, including our legal costs, are borne from the deceased estate, and there is no out of pocket cost to you.
